African SurViVors International (ASI) is concerned that the German authorities are using the charges provided by Rwandan, Monuc and local authorities to rationalize their own crimes, meaning all parties involved in the conflict and parties that are accused of mass violations of human rights with the aim of shifting the crimes they committed on the FDLR leadership. ASI is also concerned that the German’s Government has kept unlawfully in prison both FDLR leaders Ignace Murwanashyaka and his vice president Straton Musoni without any explanation to justify the two years long detention without trial in a country member of the European Union that respects all international treaties and international law – What happened from 2009 up-to-date is unquestionably a serious violation of German´s obligations under international human rights law, International law, EU and German constitutions to prolong their imprisonment indefinitely.
African SurViVors International (ASI) calls on the German government and Germans to honour the important commitment they must make to address human rights around the world and in the African Great lakes Region in particular. It’s not about the choice of the weak, the more prejudiced. It’s all about the guilty. The case should be built up with all of those blamed for crimes committed on the Congolese soil including the FDLR. It’s all about ending with impunity and violences committed on all victims and in particular on the Hutu ethnic communities members, Congolese and or Rwandan. All of them cry justice. Therefore we must be sure the condemnation is not gonna be perceived of the justice for the weak, the hated and therefore a kinda protection of Real Criminals. Are we sure Justice is done? The answer is a big No.
Germany and the world community commitment: To end up with Kagame´s impunity policy to ensure all victims get a fair justice.

The real authors of the Congo Crimes are well known because well-known documented. The UN mapping report and the earlier and recent independent inquiries from individuals and human rights organizations provide us more details and well-documented elements regarding crimes committed by all – without exception – involved parties.
The RCD leaders including Nyarugabo, Ruberwa, Bizima Karaha and several CNDP leadership and insiders namely Bosco Ntaganda, Mutebusi and Nkunda actually under Kagame´s protection in Rwanda remain untouchable. Nkunda is not actually imprisoned in Rwanda, and that the real reason for the “arrest” may have been that he had become a political liability for Kagame. He simply knows too much about Rwandan crimes in the Congo and during the 1994 Rwandan “genocide” for Kagame to permit him to remain “on the loose.

Rwandan and Ugandan invasions of the Congo since 1996 have been fuelled by the grab for Congo’s raw materials, and that FDLR are Not the real reasons for the decades-long war, that again appeared under the Kimia I and II, in a repeat of the1998-2002 “First “World War of Africa.”
The four UN reports plus the UN mapping report recently released, make clear that Rwanda has used the presence of Rwandan refugees in the Congo as justification for Rwanda’s “resource grab.”
“FDLR leadership (those inside Rwanda and protected by General Paul Kagame) must respond to those accusations if they really exist, on the other hand, General Rwarakabije, General Ngendahimana Jérôme and many others who were working for General Paul Kagame in the Eastern region of the Congo (in South and North Kivu provinces) should be brought to justice. Why are they untouchable? Only because they accepted to kneel before Kagame? What about Monuc soldiers blamed for rape and mineral resources large scale loot in the Eastern of the Congo? The trial should be done with fair justice. Is that justice or it’s all about killing the weak or shut mouths of those weaken communities and ethnic groups. If not who will arrest Kagame? The massive step ahead would be to capture RDF soldiers, Congolese soldiers who were under Paul Kagame subordination to humiliate, assassinate, mass murder the hated Hutu particularly women and children and the elderly people. False Narrative : It has been reported that FDLR has conducted “terrorist acts” in the DRC where American tourists were brutally killed at Bwindi on March 1, 1999. However, the accused were released by the US Congress Justice after getting all proofs that crimes were committed by Kagame’s RDF soldiers.
Following the December 2008 UN report, the Netherlands and Sweden cut-off all foreign aid to Rwanda , and others are considering doing so too. Other EU countries are taking their own actions as the true nature of the Kagame regime is being revealed. In early 2008, Spain indicted 40-leading members of Kagame’s government which followed a late 2006 French indictment charging Kagame and his followers with assassinating former Rwandan and Burundian presidents, the crime that triggered 1994 civilian-on-civilian killings in Rwanda.
The abuses committed in the Republic Democratic of the Congo, many of which constitute crimes under international law, include widespread and systematic incidents of torture, rape, mass murder, assassinations, enforced slavery of women from the Hutu ethnic origin, Rwandans and Congolese as well, other ill-treatment, unlawful killings and enforced disappearances.
The Spanish indictment details genocidal-style killings of Rwandan civilians by Kagame’s troops before, during, and after, the 1994 war. Before this indictment, the defendants in the dock at the ICTR had been blamed for all the mass-killings in Rwanda. But, because only the losing-side in the Rwanda war is in the dock, it is clear that the story of the “Rwandan genocide” will have much to reveal.
Frequent calls for action to end impunity, both from within and outside of DRC, have failed to yield concrete results. Survivors and the families of victims are kept in a state of intolerable limbo. The failure to address ongoing impunity violates people’s rights to truth, justice, remedy and reparations. It is also causing long-term damage to the rule of law in the country.
German is committed to investigate and reveal the fate of all of those subject to enforced disappearances and abduction during the conflict. African SurViVors International is aware of the double standards that are applied in this context where the real criminals remain at large.
The presence of RPF/RDF soldiers on the Congolese soil up to now is no longer a matter of doubt. The withdrawal of all Rwandan soldiers inside the republic of the Congo should be a must and the international community and German in particular should insist on the Kagame´s indictment for having planed, organized, triggered and incited to massive human rights violations inside both Rwanda and Democratic Republic of the Congo.
All crimes they commit are not pursued because all crimes are shifted to the hated Hutu represented by those who are determined to liberate of Rwanda. This should not be an excuse for any government to kill and destroy the human kind. As Germany did to end up with Nazism, African Survivors International urges the German Councilor and German government to help both Rwandan and Congolese people to be protected from the Rwandan Neo Nazi Paul Kagame and therefore help them retrieving peace, security and fair justice. History requires us, however, to learn from the mistakes of the past. All Germans are not Nazis. To make such a generalization is an insult and that should be prosecuted and those responsible brought to justice. Those who fought for Free Germany have never been assimilated to the German Nazi. They were supported by the international community.
Germany should learn from the past and make sure Rwandans and Congolese people are free from the Rwandan fascism and autocracy. Criminals from all sides (inside and outside of Rwanda and Congo) should be immediately brought to justice. None of us has been born to pay somebody else’s crimes. That should be considered as a blameshifting, which is unacceptable in a very serious matter involving war crimes, crimes against humanity and genocide.
At every turn people who seek justice have been obstructed and even threatened with violence or death. We saw many casualties and awful atrocities in which many of the Rwandan and Congolese Hutu communities got murdered and mass-murdered because they happened to be born Hutus.
It is not, however, too late for the German government to change course and show the world that Germans were always sustained Justice and thus Dr Murwanashyaka Ignace and Musoni are presumably innocent and therefore will have a fair trial to ensure there is no biased justice regarding all parties involved in the conflict and most importantly to ensure that survivors and families of victims can mark this year with hope.
Finally, we urge the German government to send a strong signal to the people of Congo and the international community that all crimes will never again be committed with impunity and that all perpetrators will be brought before the bar of Justice.
African SurViVors International hopes that Germany will strictly comply with national laws and humanitarian standards, and take into account the context in the region of conflict but also the international opinion.”
