Arusha TZ – Nov. 17 — The Bureau of ICTR-ADAD (Association des Avocats de la Defense), welcomes today’s Trial Chamber Judgement acquitting the second defendant in as many days. The court ordered the immediate release of Fr. Hormisdas Nsengimana, who was charged with genocide and crimes against humanity committed in Rwanda in 1994.
This week’s acquittals follow the Dec. 2008 acquittal on “genocide conspiracy or planning” charges of Gen. Gratien Kabiligi and three senior military officers including the alleged mastermind of the genocide, Theoneste Bagosora. The acquittal was published in February 2009.
The lack of evidence of “planning or conspiracy to commit genocide” requires a complete re-examination of the undeniable wave of violence that swept Rwanda in 1994, and the end of a 4-year war which began when Paul Kagame’s RPF army invaded from Uganda. The war exploded into mass civilian violence when Rwandan President Habyarimana, and Burundi’s President Ntaryamira, were assassinated in an April 1994 missile attack on Habyarimana’s plane.
Defense Counsel Emmanuel Altit (France) and David Hooper (U.K.) established that the Prosecution lacked sufficient evidence to prove that Nsengimana, who was a priest and rector of a prestigious Catholic secondary school in Butare, was at the center of a group of Hutu extremists that allegedly planned targeted attacks in 1994.
The trial court found insufficient factual and legal basis for concluding that Nsengimana was guilty of any crimes. Nsengimana’s attorneys announced they would seek compensation for his years of unlawful incarceration.
ICTR Judges Møse (Norway), Sergei Egorov (Russian Federation) and Arrey (Cameroon) issued the acquittal. Judges Mose and Egorov, with Judge Jai Jam Reddy (Fiji), also acquitted the senior military officers in the Military-1 case.
In February 2009, the English edition of a memoir by former ICTR Chief Prosecutor Carla Del Ponte confirmed major elements (it was two pages, Peter!!) of a 2007 book by her former press aide, Florence Hartmann. Both books described in detail how Ms. Del Ponte was removed from her ICTR position for insisting on fulfilling her mandate to prosecute all crimes in Rwanda in 1994. According to Del Ponte and Hartmann, the ICTR Prosecutor was called to the U.S. State Department and ordered to drop investigations of Rwandan President Paul Kagame and his military because of close ties between the U.S. government and Rwanda.
Hartmann was prosecuted at the ICTY for having published the book and Del Ponte has been ordered not to discuss her book in public, according to contemporary press accounts.
Arusha TZ – 17 nov. – Le Bureau du TPIR-ADAD (Association des Avocats de la Défense), se félicite aujourd’hui de l’Arrêt de la Chambre de Première Instance acquittant le deuxième accusé en quelques jours. Le tribunal a ordonné la libération immédiate du Père Hormisdas Nsengimana, qui était inculpé de génocide et de crimes contre l’humanité commis au Rwanda en 1994.
Les acquittements de cette semaine suivent l’acquittement en décembre 2008 des accusations de “conspiration ou planification de génocide ” contre le général Gratien Kabiligi et trois officiers supérieurs militaires, dont le cerveau présumé du génocide, Théoneste Bagosora. L’acquittement a été publié en février 2009.
L’absence de preuves de «planification ou conspiration en vue de commettre un génocide”, exige un réexamen complet de l’indéniable vague de violence qui a ravagé le Rwanda en 1994, et la fin d’une guerre de quatre ans qui a débuté lorsque l’armée du FPR de Paul Kagame a envahi le Rwanda en provenance d’Ouganda. La guerre a explosé en une violence civile de masse lorsque, en avril 1994, le président rwandais Habyarimana, et le président du Burundi Ntaryamira, ont été assassinés suite à une attaque par missiles contre l’avion de Habyarimana.
Les avocats de la défense, Emmanuel Altit (France) et David Hooper (Grande-Bretagne) ont établi que l’Accusation n’avait pas de preuves suffisantes pour prouver que Nsengimana, qui était prêtre et recteur d’une prestigieuse école secondaire catholique à Butare, ait été au centre d’un groupe d’extrémistes Hutu qui aurait planifié des attaques ciblées en 1994.
Le tribunal a constaté l’insuffisance de base factuelle et juridique pour conclure que Nsengimana était coupable d’un crime quelconque. Les avocats de Nsengimana ont annoncé qu’ils demandent une indemnisation pour ses années d’incarcération illégale.
Les juges du TPIR, Møse (Norvège), Serguei Egorov (Fédération de Russie) et Arrey (Cameroun) ont prononcé l’acquittement. Les juges Møse et Egorov, avec le Juge Jai Jam Reddy (Fidji), ont également acquitté des officiers militaires de haut rang dans le cas « Militaires-1 ».
En février 2009, l’édition en langue anglaise d’un mémoire rédigé par l’ancien procureur en chef du TPIR, Carla Del Ponte, a confirmé sur deux pages les éléments majeurs contenus dans un livre rédigé en 2007 par son ancienne attachée de presse, Florence Hartmann. Les deux livres décrivent en détail comment Mme Del Ponte a été démise de ses fonctions au TPIR pour avoir insisté d’exécuter son mandat de poursuivre tous les crimes au Rwanda en 1994.
Selon Del Ponte et Hartmann, le Procureur du TPIR a été convoquée au Département d’État américain et a reçu l’ordre d’abandonner les enquêtes concernant le président rwandais Paul Kagame et son armée, en raison des liens étroits entre le gouvernement des États-Unis et le Rwanda.
Hartmann a été poursuivie devant le TPIY pour avoir publié le livre et Del Ponte s’est vue intimer l’ordre de ne pas discuter de son livre en public, selon les rapports de presse de l’époque.
